Taiwan and Japan to Implement a Cooperative Program on Mutual Recognition of Deposit of Biological Materials for the Purpose of Patent Procedure

Under this program, applicants are allowed to make only one deposit at a designated depository either in Taiwan or Japan. In other words, applicants are no longer burdened with the inconvenience and cost of having to make a deposit in both countries. As a result, the program can significantly benefit domestic industries and academic institutes of biotechnology, pharmaceuticals, and food sciences, such as the GenMont Biotech Inc., Bio-Ray Biotech Co., Ltd., and Academia Sinica. In all, this program meets the expectation of relevant sectors in Taiwan with the country’s food science institutes now being recognized as equally eligible depositories capable of furthering cooperation with depositories in Japan.

IPR Trends Q2 2014: Patent and Trademark Statistics.

Statistics released by TIPO show an 8.14% drop in overall patenting activities, brought down mainly by decrease in both domestic and foreign invention patent applications. Hon Hai Precision Industry Co., Ltd., the all-time leader in domestic invention filing, saw a 73.03% plunge.

The 5th Taiwan-UK Videoconference on Intellectual Property Right.

TIPO and JPO to Modify Current PPH and Pilot Run PPH Mottainai for Three Extended Years

Under this new pilot, the examination result of the office of first filing (OFF) no longer has primacy over that of the office of second filing (OSF). In other words, if one of the signing parties (OFF or OSF) has already issued an examination result, the applicant may use such result to file a request for PPH with another party.

TIPO Statistics Report: Patent and Trademark Applications in 2013.

In 2013, patent and trademark applications filed with TIPO totaled 83,211 (-2.19%) and 74,031 (-0.44%) respectively, as compared to those of the preceding year. This represents the first-ever downward incline in the headway TIPO has made since the financial tsunami.

Amendment to Copyright Act Promulgated

Legislative Yuan Passes Patent Act Amendment Concerning Border Protection Measures for Patents

The main purpose of this latest amendment is to strengthen the protection of patentees. Legislator Lee Guei-min and her colleagues, having consulted relevant foreign legislations, Taiwan’s Trademark Act and Copyright Act, proposed that a mechanism of “request to detain” be introduced to the Patent Act.

Accelerated Examination Available for Green Tech Patent Application Since January 1, 2014.

On January 1, 2014, TIPO added one condition for the Inventions Relating to Green Tech (Condition 4) under the Accelerated Examination Program (AEP) and began accepting requests in order to encourage the development of the green industry and to enhance the patent predominance of green technology in Taiwan.
